Recognized Nicaraguan or Panamanian member of a qualifying pre-border Indigenous people

Costa Rica provides a protected residence procedure for recognized Nicaraguan or Panamanian members of Indigenous peoples whose historic territory or settlement predates the modern border. An eligible person may choose direct permanent residence or temporary residence.

What the current source supports

  • Establish the protected identity through a record issued by the competent authority in the country of origin or a certification from an Indigenous association registered with DGME.
  • File at an enabled DGME regional office in the border area and state the requested category, identity, parentage, nationality, occupation, address, contact, and notification details.
  • Provide a valid travel document or foreign identity document issued by the country of origin.
  • Provide birth and criminal-record certificates or the permitted sworn declaration of birth and criminal history, including the applicant’s parents’ names.
  • After approval, document enrollment with the Costa Rican Social Security Fund (CCSS) before residence documentation is issued.

Financial basis

Government service fees
Law 8764 and Decree 42814-MGP exempt this regularization and documentation process from migration fees, taxes, stamps, fines, and related charges.
Initial status
The eligible applicant may choose direct permanent residence or temporary residence. The special residence document is valid for two years and is renewable for equal periods under the implementing decree.
Renewal
Present the current identity or residence document and prove uninterrupted CCSS coverage from the date residence was granted. The special document is renewed in two-year periods.
Dependents
No automatic derivative entitlement is modeled. A family member must establish an applicable independent or family basis.
Work rights
Both temporary and permanent holders under this protected route may perform any remunerated or lucrative activity, as an employee or independently, subject to generally applicable Costa Rican legal limits.
Presence considerations
The holder may move throughout Costa Rica without territorial restriction and uses an authorized border post with the credential for entry and exit. No minimum-presence rule is inferred from the special procedure.
Permanent residence
Permanent residence is a direct option under this protected procedure, not a promised later conversion from temporary residence. DGME must approve the selected category and issue the documentation.
Citizenship relationship
Residence does not automatically confer nationality. Law 9710 separately addresses registration as Costa Rican by birth for a person who independently satisfies the constitutional basis, and it provides a culturally adapted naturalization process.
